Issue 1 from 26.03.2019Статья посвящена анализу взглядов Валерия Максима, автора сборника нравоучительных рассказов «Девять книг достопамятных деяний и высказываний» (первая половина I в. н.э.), составленного на грани двух эпох, Республики и Империи. Главная идея этого произведения – превознесение традиционных римских ценностей. Примерно 3/5 историй в сочинении Валерия Максима относится к догракханскому периоду, т.е. ко времени до событий, с которых начинают кризис Римской республики. Писатель не злоупотребляет назиданиями, скорее в его сочинении просматривается вневременное восхищение доблестью и осуждение порока, а противопоставление современности носит неявный характер. При этом он восхваляет современную ему жизнь, связывая ее блага с правящим императором. Не имея доступа к власти и ее привилегиям, он вполне мог быть искренен в своих восторгах по отношению к императору. Не только в силу традиции, но и по своему мировоззрению Валерий Максим связан с обеими эпохами, являя порой противоречивую, но очевидную связь их взглядов и ценностей. В его сочинении представлен набор знаний и представлений, которые отражали мировоззрение обычного образованного римлянина.

SACRAL ASPECTS OF EARLY REPUBLICAN DICTATORSHIP
Issue 1 from 01.01.2009The article deals with two problems: the character of dictatorship with religious purposes (especially clavi figendi causa) and the sacral content of dictio. The research has shown that religious tasks fulfilled by dictators belonged to the consul's competence, as well as in other cases of dictatorship imminuto iure. This can also apply to the rite of «driving a nail», an extraordinary magical ritual. Its association to the dictator's power was due to a precedent fixed because of the sacral principle post hoc ergo propter hoc. Religious requirements during dictio referred not to dictio itself but to the auspices preceding it. Essentially, the act of dictio did not differ from that of renuntiatio of the winner at the electoral comitia. It has nothing to do either with the cooptation or with the inauguration of a priest. The sacral content of dictio was in principle like any other action of the consul. Consuls' exclusive right to appoint dictators can be explained by the original sacral and political status of this republican magistrate as successor to the royal power. The absence of clear and definite data as to the magical content or perception of magistrates' power is due to the processes which had first led to the expulsion of the kings and then to the development of civitas.644 2 -

THE SOURCES AND CHARACTER OF MAGISTRATES ' RIGHT TO AUSPICATE: AN ANALYSIS OF THE RENUNTIATIO
Issue 1 from 01.01.2010The author examines sacral aspects of renuntiatio, i.e. of announcing the winner of the election. He maintains that the act gave the magistrate the right to public auspices, an essential part and sacral basis of magistrate's competence. The case of faulty election of M. Claudius Marcellus in 215 BC is reconsidered. Before the magistratus designatus was inducted into office, his right to take auspices remained latent as well as his potestas. Jupiter's participation in the electoral procedure showed itself in two ways: he expressed his approval of the action itself (comitia) through the auspices conducted by the leaders of electoral comitia in the night before they were held and his approval of the choice made by the community. The approval came in the form of a lot, which determined the order of announcing the results of the vote in the community. Casting lots was an auspicial procedure; but Jupiter did not express his opinion about the new magistrate's person. Choosing the person was the business of the community, its exclusive right. Republican political practice did not know any kind of special «divine investiture». Thus, magistrate's competence in the sacral field depended on whether or not he received political power, which fits in well with the basic principles of sacral and political organization of the civitas.635 2 -
